2. What Data Do We Collect and Why?
Course Purchases via Whop: When you purchase our course, the transaction is processed by Whop (Whop.com) acting as the Merchant of Record. Whop shares with us your name, email address, and username. We need this to fulfill our contract with you (provide access to the course and technical support).
Discord Integration: To access the educational content, you must connect your Discord account. We process your Discord User ID and activity logs (via a dedicated bot) to manage access rights and prevent unauthorized sharing.
Fraud Prevention & Activity Logging: We log timestamps of your access to specific Discord channels and materials. This is based on our legitimate interest in preventing "friendly fraud" (unauthorized chargebacks) and ensuring the security of our content.
Note on Payment Data: We do not collect or store your credit card details. This data is processed exclusively by Whop and its payment processors (e.g., Stripe).
Direct Outreach & Sales: If our team contacted you on social media (e.g., LinkedIn, Reddit, X), we processed your publicly available profile information based on our legitimate interest in offering relevant educational content.
Marketing: If you sign up for our newsletter, we use your email based on your consent.
Testimonials: If you share feedback, trading results, or screenshots in designated Discord channels (e.g., #testimonials), we process your Discord nickname and the content of your post based on your consent (confirmed by the act of posting) for our marketing purposes. The User may withdraw this consent at any time by sending a written request to info@orderflow-daytrading.com. Upon receipt of such a request, the Provider will, within a reasonable timeframe, remove the testimonial from future marketing materials or anonymize the data. Please note that for content already published (e.g., printed materials or finalized YouTube videos), the removal will apply to future editions or new content where technically feasible.
The User acknowledges and agrees that designated channels (e.g., #testimonials) may be made accessible to prospective members for preview and verification purposes."
Marketing Giveaways and Contests Purpose: To manage your participation in our promotional giveaways, identify winners, and deliver prizes.
Legal Basis: Performance of a contract (the Giveaway Rules you agreed to by entering) and our legitimate interest in promoting our services.
Data processed: Discord nickname, Whop username, and in the event of winning, necessary delivery details (e.g., email address or name for prize delivery).
Retention period: For the duration of the promotion and until the prize is successfully delivered and claimed, plus a necessary period for audit purposes (typically 2 years).
3. How Do We Find Your Data? (For Outreach)
We sometimes identify potential students through public platforms (social media, professional forums). If we contacted you this way, we only used information you made public. You always have the right to tell us to stop (see Section 7).
4. Who Has Access to Your Data?
We do not sell your data. We only share it with trusted partners necessary for our business:
Whop Payments LLC: Our authorized reseller (Merchant of Record) for billing and tax compliance.
Discord Inc.: The platform where the course content and community interactions take place.
Discord Bot Provider: Custom or third-party tools used for logging activity and managing user roles for security purposes.
External Sales & Marketing Specialists: We work with dedicated contractors globally (e.g., USA, Southeast Asia, Eastern Europe). All transfers are legally secured by Standard Contractual Clauses (SCCs).
HubSpot, Inc.: Our CRM provider used for managing customer and lead relationships.
5. International Data Transfers
When we work with partners outside the EU/EEA (such as Whop, Discord, or global contractors), we ensure your data is protected by Standard Contractual Clauses (SCCs) approved by the European Commission, ensuring a level of protection equivalent to the GDPR.
6. Data Retention
We keep your data only as long as necessary:
Invoices & Sales Records: Maintained for 10 years as required by Czech tax and accounting laws.
Course Access & Logs: Your access logs and activity data are stored for the duration of your 12-month membership and for up to 24 months thereafter to resolve potential payment disputes or facilitate renewals.
Leads/Outreach: If we don't start a professional relationship, we delete your data within 12 months of the last contact.
7. Your Rights
Under the GDPR, you have the right to:
Access your data and ask for a copy.
Correct any inaccurate information.
Delete your data ("Right to be forgotten").
Object to direct marketing (Opt-out).
Lodge a complaint with your local Data Protection Authority (e.g., ÚOOÚ in Czech Republic).
